Ronald MacPherson* was a retired, well loved husband and father of three. One Sunday morning, Ronald got up early and went for a walk around his neighborhood. While crossing the quiet street where he lived, Ronald was struck and killed by a speeding, careless driver.
The Kahler Personal Injury Law Firm commenced a claim on behalf of Ronald’s spouse and his three sons against the driver who caused Ronald’s death. The Firm sought damages to help compensate Ronald’s widow and his sons for their grief and for the loss of Ronald’s valuable care, support and lost future income.
The defendant’s insurer rejected this claim.
The defendant’s insurance company claimed that it was not responsible for damages for Ronald’s loss of future income because he was a retired investor and his income was uncertain. The insurer also refused to pay for support workers to help care for Ronald’s wife, who required care, because they believed that Ronald was too old to provide his wife the support she required.
The Kahler Personal Injury Law Firm gathered evidence establishing that had he not been killed, Ronald would have continued to earn a good income and that he did and would have continued to care for his wife. The Firm obtained expert reports which supported this claim and established the damages which the MacPherson family suffered as a result of Ronald’s death.
Ultimately, the defence gave in. The Kahler Personal Injury Law Firm settled the family’s claim and obtained for them the compensation they required to provide Ronald’s widow support and care for the rest of her life.

Person suffering a catastrophic brain injury in a motor vehicle collision
Joseph Connell* was a former commercial business and real estate broker, who, as he prepared for retirement, enjoyed traveling with his wife and spending time with his children.
One evening, Joseph and his wife drove across town to spend an evening visiting with friends. On their way home, a man driving a stolen car smashed into Joseph’s automobile at high speed on the highway. Joseph suffered a brain injury and damage to his spine in the collision. More concerned with caring for his wife who was also injured, Joseph rejected the ambulance attendants request that he go to hospital.
Over the course of the next few days Joseph noticed changes in his ability to think and his emotions. Joseph suffered difficulty remembering appointments, difficulty remembering people’s names and he would forget to turn off the stove after cooking. Joseph became irritable, frustrated and depressed.
Joseph experienced no success working with several lawyers in the first five years following his injury. His benefits were cut off and the defendant offered him little compensation to settle his claim.
Ultimately, Joseph transferred his file to the Kahler Personal Injury Law Firm. Brennan Kahler and his team worked hard and had Joseph assessed by the finest medical experts in the country. These efforts resulted in Joseph being designated “Catastrophically Impaired”. Joseph received access to the considerable medical benefits and attendant care he required.
The Kahler Personal Injury Law Firm’s efforts earned Joseph nearly one million dollars in compensation.

Office manager suffering a chronic pain disorder
Franca Bertolone* was a wife and mother who worked as an office manger for a collections firm in Toronto.
Franca was involved in an automobile collision and suffered injuries to her back and neck. The pain in Franca’s back and neck caused her daily pain, headaches, difficulty sleeping, fatigue and depression. Franca developed a chronic pain disorder.
The chronic pain disorder caused Franca difficulty at work and at home. She had no energy. She was in constant pain and had little energy to socialize with friends or participate in any of the activities she previously so enjoyed.
Ultimately and despite her best efforts, Franca was forced to give up her job as office manager and take an early, unplanned retirement.
The Kahler Personal Injury Law Firm helped Franca advance her claim by arguing that she should recover all of her future wages to the time she intended to retire, at age 65.
The defendant rejected the claim. It argued that Franca never intended to work till age 65. The defendant claimed that she could still work and that she was using the car collision as an excuse to take a “paid, early retirement.”
Brennan Kahler and The Kahler Personal Injury Law Firm pushed the action on toward trial. Ultimately, the defendant was forced to settle the claim and Franca recovered compensation that ensured that she would be taken care of for the rest of her life.

Young person suffering blinding injury in slip and fall
Thomas Vulkanovich* was an active, happy boy who lost the vision in one eye when he stumbled and fell into a display hanger in a department store.
The Kahler Personal Injury Law Firm helped Thomas advance his claim.
The defendant denied that it was liable for the injury. It also denied that Thomas had suffered any long term financial losses. It argued that since he was a bright boy, he could still earn just as much with vision in one eye as he could with full vision.
The Kahler Personal Injury Law Firm retained a store safety expert, who was able to determine that the display hanger which hurt Thomas was an old, unsafe hanger which should never have been used in the store. The expert helped to establish that the store was liable for Thomas’ injury because it fell below the standard of care which it was expected to meet.
The Kahler Personal Injury Law Firm worked with Thomas, his family and medical and vocational experts to determine the affect of the eye injury on Thomas’ future earning potential.
Using the medical and vocational experts’ opinions as support, Brennan argued that Thomas would suffer a significant loss of earnings because his limited vision would restrict him from pursuing a number of high paying jobs which for which he would otherwise be suited.
The defendant was forced to settle the claim. The Kahler Personal Injury Law Firm helped Thomas recover hundreds of thousands of dollars in personal injury compensation.

Woman suffers psychological trauma after son dies in collision
Linda Shaw* was a wife and mother who worked at an honest job assembling car parts in a factory. She enjoyed a good life that was filled with spending time with her children and her young grandchildren.
One morning Linda received a devastating phone call. She was told that there had been a car crash. The crash claimed the life of her eldest son.
The loss of her son caused Linda to suffer significant psychological trauma. Linda became depressed and anxious. She suffered panic attacks and was unable to work.
The Kahler Personal Injury Law Firm arranged for Linda to receive counseling and support. The Firm ensured that her insurance company paid her lost wages. The Firm also commenced an action against the driver responsible for the collision.
The defendant denied liability for Linda’s losses. It claimed that because she was not present at the collision and did not suffer any physical injuries, she could not recover damages compensating her for her lost income or for her pain and suffering.
The Kahler Personal Injury Law Firm hired medical experts who established that Linda’s psychological injuries were the direct result of her son’s death. The Firm used these reports as support for the argument that the law permitted Linda to recover her damages.
The Kahler Personal Injury Law Firm pushed the matter on toward trial. Ultimately, the defendant insurer was forced to settle the claim. The insurer paid Linda her lost income and her pain and suffering damages. The Firm also ensured that the defendant provided Linda with funds so that she could obtain counseling and support to help her cope with her loss.

Insurance company benefit dispute
Brad Carlson* was a young man who worked in the shipping and receiving department of a large, national delivery firm. Brad was healthy, strong and enjoying the prime of his life.
A car crash changed Brad’s life forever.
One evening, while driving home, Brad momentarily lost control of his car. The car skipped up a curb and struck a tree. Brad was thrown into the dashboard of his car. The impact broke Brad’s neck and damaged his spinal cord. The spinal cord injury rendered Brad paraplegic.
Brad lost sensation and control over the lower half of his body. Brad became dependant on family, friends and professional caregivers to perform many routine daily activities. Brad was unable to return to his work.
Brad was at fault for the collision, so there was no one to sue. However, like every other person hurt in a car crash in Ontario, Brad had access to no-fault benefits.
Brennan Kahler helped Brad obtain from his insurer all of the treatment and goods he needed to get his life back on track. When Brad’s insurer refused to pay his benefits, Brennan commenced an action against the insurer and compelled it to purchase a modified van and a new, accessible apartment for Brad.
Brennan then persuaded Brad’s insurer to settle his no-fault benefits in a lump sum. Once settled, Brennan arranged for Brad to meet with an investment specialist who helped Brad invest his settlement in a tax free structured annuity. Payments he receives each month from the annuity provide Brad with the freedom to decide how he wants to spend his money and the peace of mind that comes with knowing that this stream of income is guaranteed for the rest of his life.
Clients like Brad are often well advised to settle their no-fault benefits with their insurers. Settling the claim allows the injured person to decide how they want to spend their insurance funds. They no longer need to ask their insurance company for permission. Injured people who settle their accident benefits claims are also entitled to decide how to invest their insurance funds to plan for their future. Also, once the claim is settled, the injured person is never again required to comply with insurers requests for assessments.
